Contracts Committee

Promoting the use of standard forms of building contract, working with SBCC in the best interests of Scottish architects, ensuring that the interests of members and clients and their insurers are met through encouraging standard forms of contract.

Terms of Reference

Membership

Maximum 12/14 members to include:

  • Convenor
  • Representatives of practices of varying size from the six Chapters
  • Local Authority Representative
  • Contractual and legal experts
  • Student Representative

In attendance:

  • Practice Manager

Meetings do not require to be strictly quorate but attendance of fewer than 5 members must be notified to the President.

Purpose

  • To provide effective support for practices and members.
  • To maintain and enhance information and advice services in areas such as appointments and building contracts
  • To contribute to the development of codes and standards and to the promotion of good practice procedures through both Scottish-based and UK bodies

Key Roles and Responsibilities

  • To promote the use of standard forms of building contract that meet the needs of clients and are acceptable to architects and their insurers.
  • To promote the requirements of members and clients in contractual arrangements through the forum of SBCC and JCT
  • To promote the interests of members and clients in liaison with other RIAS Committees, and other representative bodies of the construction industry in Scotland.

Functions

  • To publish relevant guidance on contractual procedures and good practice.
  • To oversee any changes in the RIAS Standards Forms of Appointments.

Authority and Reporting Requirements

  • The Committee is subordinate to PPC and Council (on urgent policy issues the Convenor shall confer with the President).
  • The Committee shall report in writing to each meeting of Council.
  • Any papers on policy matters should be presented to PPC and Council.
  • The Convenor shall liaise with the Practice Manager as appropriate when dealing with matters of policy and in the preparation of reports to PPC and Council.
